Failed breathalyzer, possessed drugs
Morden resident Joshua Reginald Lutz, 28, pleaded guilty Dec. 15 to driving while his blood/alcohol level exceeded the legal limit and to possession of a narcotic, cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act (CDSA).
For the blood alcohol offense, Judge Alan Tufts fined Lutz $1,150 plus a $172.50 victim surcharge, or 20 days’ custody on willful default, and prohibited him from driving in Canada for a year. The Registry of Motor Vehicles will ban Lutz from driving in the province for at least a year.
For the CDSA offense, Judge Tufts fined Lutz $100 plus a $15 victim surcharge or one day in custody on willful default.
Lutz committed the offenses in Greenwood Oct. 8, 2008 when police found he had 160 and 160 mgs of alcohol per 100 ml of blood.
Had weapon, breached probation
Kentville resident Leslie Charles Owen Newell, 20, pleaded guilty Dec. 15 to possession of a prohibited weapon and to failing to comply with a probation order.
Judge Tufts fined Newell $150 plus a $22.50 victim surcharge, or two days in custody on willful default, for each of the convictions.
Newell committed the offenses in Kentville Aug. 26, 2008.
Breached probation
Dartmouth resident Diana Theresa Gallagher, 53, pleaded guilty Dec. 29 to failing to comply with a probation order.
Judge Tufts sentenced Gallagher to one day in custody deemed served by her court appearance.
Gallagher committed the breach in Kentville between Sept. 13 and Oct. 22, 2007 when she failed to inform the court of any residential changes.
Big fines for MVA offenses
Kentville resident Scott Anthony Negus, 35, pleaded guilty Dec. 15 to driving without the required liability insurance and to driving while his privilege of obtaining a license was revoked, both contrary to the Nova Scotia Motor Vehicles Act (MVA).
Judge Tufts fined Negus $1,000 plus a $150 victim surcharge and $107 in costs for having no insurance, and $1,000 for the license offense.
Negus committed the offenses in Kentville Nov. 15, 2008.
Drove carelessly, imprudently
Aylesford resident Nicholas Todd Jones, 18, pleaded guilty Dec. 29 to failing to drive in a careful and prudent manner, contrary to the MVA.
Judge Tufts fined Jones $500 and suspended his license between Dec. 30, 2008 and Jan. 13, 2009.
Jones committed the offense in Aylesford Nov. 22, 2008.
Sped
Waterville resident Benjamin Albert Bond, 27, pleaded guilty Dec. 29 to driving between 16 and 30 kilometres per hour in excess of the posted limit, contrary to the MVA.
Judge Tufts fined Bond $150 plus a $22.50 victim surcharge and $107 in costs and suspended his license between Jan. 12 and 19, 2009.
Bond committed the offense on Highway 12 in South Alton Nov. 13, 2008.
