Jailed for assault, confinement, breaches
The court has jailed a Kings County man of no fixed address for assault, confinement and a number of court order breaches.
In Kentville provincial court Dec. 23, Judge Frank Hoskins sentenced Leonard Shawn Gallagher, 35, to 10 months and two weeks’ custody for assault causing bodily harm, unlawful confinement, failing to comply with a probation order, failing to comply with an undertaking and failing to attend court as ordered.
The sentence will be followed by 24 months’ probation, conditions of which include Gallagher taking any recommended assessment, counselling or treatment; refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs; and not residing with or contacting a specific person.
The judge also ordered Gallagher to provide a DNA sample to be kept on record and imposed a lifetime firearms prohibition on him.
Gallagher committed all the offenses but the failure to attend at a Canning residence Aug. 9, and failed to attend court in Kentville July 30. He pleaded guilty to the charges Dec. 4.
CSO suspended
The court was satisfied Dec. 23 that north Kentville resident Joseph Albert States, 38, had breached his May 7, 2007 conditional sentence order (CSO).
Judge Hoskins suspended the two-year-less-a-day CSO for four months, meaning States will serve the time in custody.
In Kentville Nov. 17, States broke the CSO condition he not use alcohol or other intoxicants. He admitted the breach Dec. 17.
The CSO was for a number of Controlled Drugs and Substances Act (CDSA) convictions, including cocaine possession, as well as breaches in various communities during 2007.
States also pleaded guilty to possession of cannabis marijuana, a Schedule II drug under the CDSA.
Judge Hoskins sentenced States to a further seven days concurrent to time being served.
Probation for assault, firearms storage
In court Dec. 18, Judge Alan Tufts suspended sentencing and imposed a term of 18 months’ reporting probation on Kentville resident Trevor John MacEachern, 33, for assault causing bodily harm and for storing a firearm in a careless manner.
Probationary conditions include MacEachern taking any recommended assessment, counselling or treatment; refrain from possessing or consuming alcoholic beverages or non-medically prescribed drugs; and initiating no direct contact with the assault victim.
MacEachern committed the offenses in Kentville Nov. 2 and pleaded guilty to the charges Nov. 17.
Refused to provide breath sample
Kentville resident Reginald Jessome, 72, pleaded guilty Dec. 22 to refusing to provide a breath sample for blood/alcohol analysis.
Judge Claudine MacDonald fined Jessome $1,200 plus a $180 victim surcharge, or 21 days in custody on willful default, and prohibited him from driving in Canada for a year. The Nova Scotia Registry of Motor Vehicles will ban Jessome from driving in the province for at least a year.
Jessome committed the refusal in Kentville Nov.16.
Failed undertaking
Kingston resident Math James Steven Lowe, 20, pleaded guilty Dec. 23 to failing a court undertaking not to possess or consume alcoholic beverages.
Judge Hoskins fined Lowe $100 plus a $15 victim surcharge, or one day in custody on willful default.
Lowe committed the breach in Greenwood March 9.
Drove with no insurance
Judge Tufts found Bridgetown, Annapolis County resident Parry Jack Fredericks, 41, guilty Dec. 18 of driving without the required liability insurance, contrary to the Nova Scotia Motor Vehicles Act (MVA).
The judge fined Fredericks $1,000 plus a $150 victim surcharge and $107 in costs.
Fredericks committed the offense in Aylesford Feb. 24.
In other court matters
Judge MacDonald found Melvern Square resident William L. Spurr, 51, guilty Dec. 23 of not using an available seatbelt, contrary to the MVA, and fined him $50 plus a $7.50 victim surcharge and $107 in costs.
Spurr committed the offense in Kingston Aug. 6.
Convicted automatically
In court Dec. 18, Judge Tufts convicted automatically Kingston resident Angel Judith Clow, 32, of failing to drive in a careful and prudent manner for conditions, contrary to the MVA, and fined her $250 plus a $37.50 victim surcharge and $107 in costs.
Police laid the charge on Highway 101 near Aylesford Oct. 11.

Dec. 18, Judge Tufts convicted automatically Harbourville resident Timothy Joseph Keddy, 23, of driving while his privilege of obtaining a license was suspended, contrary to the MVA, and fined him $1,000.
Police laid the charge on Brooklyn Street Oct. 23.

Judge Tufts convicted automatically Kentville resident Leonard Gordon Schofield, 25, Dec. 18 of driving without a license, contrary to the MVA, and fined him $150 plus a $22.50 victim surcharge and $107 in costs.
Police laid the charge on Highway 1 near Berwick Oct. 9.
