More penitentiary time for thefts
A White Rock man has received for federal time for three thefts from Kings County businesses.
Robert Saboto Peters, 33, pleaded guilty in Kentville provincial court Thursday, Nov. 27 to thefts of property valued at less than $5,000 from grocery outlets.
Judge Claudine MacDonald sentenced Peters to 20 days in custody each for the thefts, for a total of 60 days, to be served consecutively with a current federal sentence.
Peters committed the thefts in New Minas Sept. 19 and Oct. 21, and Kingston Oct. 21.
More than twice the limit
Waterville resident William Lloyd Daniels, 57, pleaded guilty Monday, Nov. 24 to driving while his blood-alcohol readings were more than twice the legal limit.
Judge MacDonald fined Daniels $1,300 plus a $195 victim surcharge, or 23 days in custody on willful default, and prohibited him from driving in Canada for a year.
The Nova Scotia Registry of Motor Vehicles will ban Daniels from driving in the province for at least a year.
Daniels committed the offense in Black Rock Sept. 26 when police found he had blood-alcohol readings of 210 and 210 milligrams of alcohol per 100 millilitres of blood.
The legal limit is 80 mg/100 ml and the Criminal Code gives courts to power to impose heavier penalties in those breathalyzer convictions in which readings exceed 160 mg/100 ml.
Had care and control
Black Rock resident Steven Donald Sim, 39, pleaded guilty Nov. 24 to having care and control of a vehicle while his blood-alcohol readings exceeded the 80 mg/100 ml limit.
Judge MacDonald fined Sim $1,300 plus a $195 victim surcharge, or 23 days in custody on willful default. She also prohibited him from driving in Canada for a year, a ban the Motor Vehicles Registry will at least match in the province.
Sim committed the offense in Lakeville Sept. 19 when police found he had blood-alcohol readings of 160 and 160 mg/100 ml.
Drove with illegal readings
Centreville resident Howard Basil Parker, 59, pleaded guilty Monday, Dec. 1 to driving while his blood-alcohol readings exceeded the 80 mg/100 ml legal limit.
Judge Alan Tufts fined Parker $1,050 plus a $157.50 victim surcharge, or 18 days in custody on willful default, and prohibited him from driving in Canada for a year.
The Motor Vehicles Registry will impose a ban that is at least as long.
Parker committed the offense in Kentville Oct. 27 when police found he had blood-alcohol readings of 130 and 130 mg/100 ml.
Breached undertakings
New Minas resident Rosaire Michel Blackburn, 52, pleaded guilty Nov. 27 to two charges of failing to comply with police undertakings.
Judge MacDonald suspended sentencing on Blackburn for the convictions and imposed a term of six months’ non-reporting probation on him.
Blackburn committed the breaches in New Minas Sept. 12 and 30.
Failed to report
Welsford resident John Alexander VanOostrum, 35, pleaded guilty Nov. 24 to failing to comply with a probation order to report to Corrections officials.
Judge MacDonald suspended sentencing on VanOostrum for the breach and imposed a term of four months of reporting probation on him, to be consecutive with any other being served.
VanOostrum committed the breach in Kentville between Aug. 13 and Oct. 31.
Walked off with shoes
Kentville resident Anthony Michael Bennett, 28, pleaded guilty to theft of property -- a pair of shoes -- valued at less than $5,000.
Judge Tufts fined Bennett $75 or one day in custody on willful default.
Bennett committed the theft at a New Minas business Oct. 3.
Had untaxed smokes
Berwick resident Donna Graves, 49, pleaded guilty Dec. 1 to possessing unstamped cigarettes for sale, or offering for sale, contrary to the Excise Act. Judge Tufts fined Graves $500.
Graves committed the offense in Berwick Sept. 9.
Received conditional discharge
Judge MacDonald granted a conditional discharge Nov. 25 to Wilmot resident Nelson Ray Swinamer, 19, for uttering a death treat, threatening to burn a property and possession of an axe for the purpose of committing an offense.
The discharge is pending one-year probation, conditions of which include Swinamer taking any recommended counselling, refrain from contact with a specific person and not being in proximity of that person’s residence.
The judge also banned Swinamer from possessing firearms for three years.
The charges stemmed from an incident in Lake Paul Aug. 3. Swinamer pleaded guilty to the charge Oct. 14.
Convicted automatically
Judge MacDonald convicted automatically Church Point resident Danielle Lorraine LeBlanc, 30, Nov. 25 of driving between 16 and 30 kilometers per hour in excess of the posted limit, contrary to the Nova Scotia Motor Vehicles Act (MVA) and fined her $150 plus a $22.50 victim surcharge and $107 in costs.
The judge also suspended LeBlanc’s license between Dec. 9 and 16.
Police laid the charge at Exit 12, Highway 101, April 19. LeBlanc failed to attend court for the scheduled hearing.

Judge MacDonald convicted automatically East Lawrencetown, Halifax County, resident Kimberly Rae Naugle, 46, Nov. 24 of failing to obey a stop sign, contrary to the MVA, and fined her $50 plus a $7.50 victim surcharge and $107 in costs.
Police laid the charge in Kentville Oct. 12. Naugle had requested a remission of penalty Nov. 17, but failed to attend court Nov. 24.
In other court matters
Wolfville resident Douglas Robert Weiss, 18, pleaded guilty Nov. 24 to underage drinking, contrary to the Nova Scotia Liquor Control Act (LCA), and requested a remission of penalty.
Declining to grant the remission, Judge MacDonald fined Weiss the full fine of $300 plus a $45 victim surcharge and $107 in costs.
Weiss committed the offense in Wolfville Sept. 25.

Wolfville resident Jason Christopher Smith, 19, pleaded guilty Nov. 24 to making noise that disturbed the peace and tranquility of the community, contrary to the Town Of Wolfville Bylaw. He requested a remission of penalty.
Judge MacDonald declined to grant the remission and fined Smith $100 plus a $15 victim surcharge and $107 in costs.
Smith committed the offense in Wolfville Oct. 26.
