Drove with high readings
The court has fined a New Ross man for driving while his blood-alcohol readings exceeded the legal limit.
Aaron Gerald English, 35, pleaded guilty to the charge in Kentville provincial court Monday, Nov. 17.
Judge Alan Tufts fined English $1,200 plus a $180 victim surcharge, or 21 days in custody on willful default, and prohibited him from driving in Canada for a year.
The Nova Scotia Registry of Motor Vehicles will ban English from driving in the province for at least a year.
English committed the offense in Blue Mountain Aug. 19, when police found that he had blood-alcohol readings of 200 and 200 milligrams of alcohol per 100 millilitres of blood.
The legal limit is 80 mg/100 ml, and the Criminal Code of Canada provides for enhanced penalties in those breathalyzer convictions in which readings exceed 160 mg/100 ml, or there are other aggravating circumstances.
Had care and control
Berwick resident Colleen Mary Dagnall, 57, pleaded guilty Nov. 17 to having care and control of a motor vehicle while her blood-alcohol readings exceeded the 80-mg/100 ml legal limit.
Judge Tufts fined Dagnall $1,200 plus a $180 victim surcharge, or 21 days in custody on willful default. He also prohibited her from driving in Canada for a year, a ban the Registry of Motor Vehicles will at least match.
Dagnall committed the offense in New Minas Sept. 11, when police found she had blood-alcohol readings of 180 and 180 mg/100 ml.
Fined for breathalyzer
Sambro, Halifax County, resident mark Christopher Smith, 31, pleaded guilty Nov. 17 to driving while his blood-alcohol readings exceeded the 80 mg/100 ml limit.
Judge Tufts fined Smith $1,050 plus a $157.50 victim surcharge, or 18 days in custody on willful default, and prohibited him from driving in Canada for a year, a ban the Registry of Motor Vehicles will at least match.
Smith committed the offense in Kentville Oct. 5, when police found that he had blood-alcohol readings of 130 and 130 mg/100 ml.
Found guilty of care and control
Judge Claudine MacDonald found Wolfville resident James Patrick Grant, 61, guilty Nov. 17 of having care and control of a vehicle while his blood-alcohol readings exceeded the 80-mg/100-ml limit.
The judge fiend Grant $800 plus a $120 victim surcharge, or 14 days in custody on willful default, and prohibited him from driving in Canada for a year, a period the Motor Vehicles registry will at least match.
Grant committee the offense in Kentville May 13, when police fond that he had blood-alcohol readings of 150 and 150 mg/100 ml.
Probation for assault
Judge Tufts suspended sentencing on Kentville Gerald Brian Sanford, 42, Nov. 17 for an assault conviction and imposed a term of one year reporting probation on him.
A condition of the probation is for Sanford to take any recommended assessment, counselling or treatment.
Sanford committed the assault in Kentville Oct. 30.
Failed probation
Dartmouth resident Robert Lee Boss-Mannette, 20, pleaded guilty Nov. 17 to failing to comply with a probation order.
Judge Tufts fiend Boss-Mannette $300 plus a $45 victim surcharge, or five days in custody on willful default.
Boss-Mannette committed the breach in Kentville Oct. 26.
Fined for breach
Grafton resident Catherine Marie Wade (McCarthy), 44, pleaded guilty Nov. 17 to failing to comply with a probation order.
Judge Tufts fined Wade $200 or three days in custody on willful default.
Wade committed the breach in Kentville Oct. 16.
Fined for theft, not attending
Millville resident Paul Berd Cardeneo, 39, pleaded guilty Nov. 17 to theft of property valued at less than $5,000 and to failing to attend court as ordered.
Judge MacDonald fiend Cardeneo $300 plus a $45 victim surcharge, or five days in custody on willful default for the theft, and $200 plus a $30 victim surcharge, or three days in custody.
Cardeneo committed the theft at an Aylesford restaurant March 27, and the failure to attend in Kentville June 23.
Failed to file
Coldbrook resident Paul Sorochan, 56, pleaded guilty Nov. 17 to two counts of failing to file income tax returns, for 2005 and 2006, contrary to the Income Tax Act.
Judge Tufts fined Sorochan $1,000 or 15 days in custody on willful default for each of the offenses.
Sorochan has 60 days to comply with sentence.
Sorochan committed the offenses in Coldbrook March 31 and April 15.
License suspended or revoked
Kentville resident Tony Patrick Wellwood, 20, pleaded guilty Nov. 17 to driving while his license was suspended, contrary to the Nova Scotia Motor Vehicles Act (MVA).
Judge Tufts fined Wellwood $1,000.
Wellwood committed the offense in Kentville Oct. 11.

South Berwick resident Jonathan Conrad Hiltz, 38, pleaded guilty Nov. 17 of driving while his license was suspended, contrary to the MVA.
Judge Tufts fined Hiltz $1,000.
Hiltz committed the offense in Berwick Aug. 22.

Aldersville resident Judson Oran Reeves, 24, pleaded guilty Nov. 17 to driving while his license was revoked, contrary to the MVA.
Judge Tufts fined Reeves $1,000.
Reeves committed the offense in South Alton Sept. 4.
Privilege revoked or suspended
Canning resident Thomas Frank Stafford, 38, pleaded guilty Nov. 17 to driving while his privilege was revoked, contrary to the MVA.
Judge Tufts fined Stafford $1,000.
Stafford committed the offense in Kentville Aug. 2.

Canning resident Ashley Dawn Arnburg, 20, pleaded guilty Nov. 17 to driving while her privilege of obtaining a license was suspended, contrary to the Act.
Judge Tufts fined Arnburg $1,000 but remitted $700 of the fine.
Arnburg committed the offense in north Kentville July 16.
Granted conditional discharge
Judge Tufts granted a conditional discharge Nov. 17 to Jeremy Lee Dunbar, 19, on a charge of theft of property valued at less than $5,000. The discharge is pending three months reporting probation.
A probation condition is that he perform 10 hours community service.
The charge stemmed from an incident at a New Minas department store Jan. 21.
In other court matters
Judge MacDonald found Port Williams resident Ryan Miller, 19, guilty Nov. 17 of littering from a vehicle, contrary to the MVA, and fined him $250 plus a $37.50 victim surcharge and $107 costs.
Miller committed the offense in north Kentville May 4.

Wolfville resident Carly Alana MacDonald, 20, pleaded guilty Nov. 17 to illegal possession of liquor, contrary to the Nova Scotia Liquor Control Act, and requested a remission of penalty.
Granting the remission, Judge Tufts fined MacDonald $50 of the total $452 -- $300 plus a $45 victim surcharge and $107 costs.
Convicted automatically
Judge MacDonald automatically convicted Bennett’s Bay resident Beverly Ann Allen, 43, Nov. 17 of two counts of failing to register a dog, contrary to the Kings County Bylaw, and fined her $100 plus a $15 victim surcharge and $107 costs each.
Police laid the charge in Bennett’s Bay Dec. 11, 2007.
Allen had pleaded not guilty to the charges but failed to appear for trial.
