CSO breached, terminated
The court has terminated the conditional sentence order (CSO) of an Aylesford man, who now has to spend the remainder of the term in custody.
Zack Ray Hiscoe, 21, admitted in Kentville provincial court Wednesday, Nov. 12, to breaching the CSO.
Judge Claudine MacDonald terminated the sentence and ordered Hiscoe to serve the remaining 78 days in custody.
Hiscoe committed the breach Nov. 7, when he broke the condition to refrain from alcoholic beverages. He also faces a criminal charge from the incident.
Hiscoe received the 12-month CSO Feb. 6 for an assault causing bodily harm, which he committed in Greenwood in April 2006.
Jailed for breaches
Michelle Lynn Latta, 21, of no fixed address, pleaded guilty Monday, Nov. 10, to failing to comply with a probation order and to failing to comply with an undertaking.
Judge MacDonald sentenced Latta to 20 days in custody for each breach, top be served concurrently.
Latta committed the breaches in Kentville Nov. 8.
Breached probation
Wolfville resident Peter Michael MacDonald, 43, pleaded guilty Nov. 12 to two counts of failing to comply with probation orders.
Judge MacDonald suspended sentencing on MacDonald on the convictions and imposed six months reporting probation on him.
MacDonald committed the breached in Kentville between Aug. 31, 2007, and March 20, 2008, when he failed to report to Corrections officials and failed to pay an amount of restitution.
The new probation conditions include that MacDonald pay the restitution.
Possessed marijuana
Judge Alan Tufts fined Kentville resident Mark Walter Harris, 34, $750 plus a $112.50 victim surcharge, or 13 days in custody, for possession of cannabis marijuana, a Schedule II drug under the Controlled Drugs and Substances Act.
Harris committed the offense in Canning March 11 and pleaded guilty to the charge Sept. 23.
Drove while disqualified
Middleton resident Mark Cecil Graves, 25, pleaded guilty Nov. 10 to driving while disqualified, contrary to the Criminal Code.
Judge MacDonald fined Graves $500 plus a $75 victim surcharge, or eight days in custody on willful default. She also prohibited him from driving in Canada for a year, a ban the Nova Scotia Registry of Motor Vehicles will at least match.
Graves committed the offense in Aldersville July 29.
Failed undertaking
Kentville resident Ivan Howard Reid, 48, pleaded guilty Nov. 10 to failing to comply with an undertaking.
Judge MacDonald fined Reid $300 plus a $45 victim surcharge, or five days in custody on willful default.
Reid committed the breach in Kentville Sept. 27.
Drove while privilege suspended
Wolfville resident Eric Jason Johnstone, 31, pleaded guilty Nov. 10 to driving while his privilege of obtaining a license was suspended, contrary to the Nova Scotia Motor Vehicles Act (MVA).
Judge Tufts fined Johnstone $500.
Johnstone committed the offense on Highway 101 in Greenwich May 31.
Conditional discharge
Judge MacDonald granted a conditional discharge to Centreville resident Arthur Dale Mahar, 55, Nov. 12 on a charge of committing mischief by interfering with the lawful enjoyment of property.
The discharge is pending six months non-reporting probation, during which time he must stay away from a specific address.
The charge resulted from an incident at Ross Corner March 12. Mahar pleaded guilty to the charge Nov. 12.
In other court matters
Wolfville resident Bradford D. Hopgood, 56, pleaded guilty Nov. 10 to driving between one and 15 kilometeres per hour in excess of the posted speed limit, contrary to the MVA.
Judge Tufts fined Hopgood $100 plus a 415 victim surcharge and $107 costs.
Hopgood committed the offense on Highway 101 in Avonport April 11.

New Minas resident Janice MacLean, 28, pleaded guilty Nov. 10 to owning a dog that ran at large, contrary to the Kings County Animal Control Bylaw.
Judge Tufts fined MacLean $100 plus a $15 victim surcharge and $107 costs.
MacLean committed the offense in New Minas June 6.

Berwick resident William Edward Benjamin, 20, pleaded guilty to not wearing a helmet while skateboarding, contrary to the MVA.
Judge Tufts fined Benjamin $25 plus a $3.75 victim surcharge and $107 costs.
Benjamin committed the offense in Berwick April 14.
