Refused to provide sample
A Port Williams woman has received a fine and probation for refusing to provide a breath sample for blood/alcohol analysis.
In Kentville provincial court Oct. 30, Judge Claudine MacDonald fined Grace Marie Parker, 36, $1,000 plus a $150 victim surcharge, or 17 days in custody, for refusing to provide the breath sample.
The judge also imposed a term of one-year reporting probation on Parker, conditions of which include the accused taking any recommended assessment, counselling or treatment; and refraining from possessing or consuming alcoholic beverages or non-medically prescribed drugs.
The court prohibited Parker Oct. 8 from driving in Canada for two years, a ban the Nova Scotia Registry of Motor Vehicles will at least match.
As well, the judge fined Parker $1,000, of which $500 was remitted, plus a $75 victim surcharge for driving while her privilege of obtaining a license was revoked, contrary to the Nova Scotia Motor Vehicles Act (MVA).
Parker committed the offenses in Kentville Jan. 16 and pleaded guilty to the charges Oct. 8.
Found guilty of breathalyzer
Judge MacDonald found Meadowvale, Annapolis County, resident Rhonda Lee Sawler, 34, guilty Oct. 30 of having care and control of a vehicle while her blood/alcohol readings exceeded the legal limit.
The judge fined Sawler $700 plus a $105 victim surcharge, or 12 days in custody on willful default, and prohibited him from driving in Canada for a year.
The Registry of Motor Vehicles will ban Sawler from driving in the province for at least a year.
Sawler committed the offense in Greenwood Dec. 12, 2007 when police found she had blood/alcohol readings of 120 and 110 milligrams of alcohol per 100 millilitres of blood.
The legal limit is 80 mg/ 100 ml.
Probation for breaches
Judge MacDonald suspended sentencing on Nicole Lynn Silver, 25, of no fixed address, on convictions of failing to comply with a probation order and failing to comply with a court undertaking, and imposed a term of one-year reporting probation on her.
A probationary condition includes that Silver take any recommended assessment, counselling or treatment.
Silver committed the breaches in Kentville Aug. 28 and pleaded guilty to the charges Sept. 15.
Drove while license suspended
Judge MacDonald found Kentville resident Carlee Victoria Keddy, 20, guilty Oct. 29 of driving while her license was suspended, contrary to the MVA.
The judge fined Keddy $250 plus a $37.50 victim surcharge. Keddy committed the offense in Kentville July 8.
Convicted automatically
Judge MacDonald automatically convicted Halifax resident Mashaallah Moslehi, 63, Oct. 30 of passing in the face of oncoming traffic, contrary to the MVA, and fined him $150 plus a $22.50 victim surcharge and $100 in costs.
Police laid the charge in Wolfville Aug. 8. Moslehi appeared in court on the charge Oct. 22 and was scheduled for trial Oct. 30, when he didn’t appear as ordered.
