Sexual offence

The court has handed James Wellesley Sherrard, 63, Berwick, a suspended sentence with probation for inviting a person under the age of 14 years to touch his body for a sexual purpose.

Sherrard entered a guilty plea to the charge Sept. 8, 2008. The matter was adjourned to Oct. 21, 2008 to allow time for a pre-sentence report to be prepared and for sentencing. The court handed Sherrard a suspended sentence with 30 months’ probation Oct. 21. The court granted a primary DNA order and granted a 20-year SOIRA (Sex Offender Information Registration Act) order.

Sherrard committed the offence in Berwick between Jan. 1, 2000 and Feb. 4, 2008.

Custody for mischief, recognizance offences

The court has sentenced John Patrick Jordan, 36, no fixed address, to 14 days in custody for committing mischief by willfully damaging property to a value not exceeding $5,000 and for two counts of failing without lawful excuse to comply with a recognizance by which he was bound.

Jordan entered guilty pleas to the charges Oct. 23, 2008. He was sentenced to 14 days in custody on each charge, to be served concurrently, for a total of 14 days in custody on the three charges.

Jordan committed the first offence of failing without lawful excuse to comply with a recognizance by which he was bound in Kentville Oct. 5, 2008. He committed the second offence of failing without lawful excuse to comply with a recognizance by which he was bound and the offence of committing mischief by willfully damaging the property of the Town of Kentville Oct. 8, 2008.

Assault, probation offence

The court has handed Carson Lee Bezanson, 24, Kentville, a conditional sentence with probation for assaulting an individual and for willfully failing to comply with a probation order by which he was bound.

Bezanson entered guilty pleas to the charges Sept. 8, 2008. The matters were adjourned to Oct. 21 to allow time for a pre-sentence report to be updated and for sentencing. The court handed Bezanson a two-month conditional sentence with eight months’ probation, concurrent to each other and consecutive to his present sentence, Oct. 21. The court granted a secondary DNA order in relation to the assault charge.

Bezanson committed the offences in Kentville July 4, 2008.

Assault, failure to comply

The court has handed Steven Arnold Scotney, 22, Aylesford, a suspended sentence with probation and fined him for assaulting an individual and unlawfully failing to comply with an undertaking by which he was bound.

Scotney didn’t enter an official plea to the assault charge, but the court set a trial date for Sept. 24, 2008. Scotney was found guilty at trial Sept. 24 and the matter was adjourned to Oct. 22 for sentencing. The court handed Scotney a one-year suspended sentence with one year of reporting probation Oct. 22.

Scotney entered a guilty plea Feb. 25, 2008 to the charge of unlawfully failing to comply with a condition of an undertaking by which he was bound. The matter was adjourned to Oct. 22 for sentencing. He was fined $345 and has been given until May 25, 2009 to pay or spend five days in custody on willful default.

Scotney committed the assault in Aylesford Dec. 21, 2007. He committed the offence of unlawfully failing to comply with an undertaking in Kentville Jan. 24, 2008.

Suspended sentence for assault

The court has handed Richard Allen Adams, 45, Grafton, a suspended sentence with probation for assaulting an individual.

Adams entered a not guilty plea to the charge May 20, 2008. The matter was adjourned to July 30 for trial. Adams changed his plea to guilty prior to the scheduled trial July 30 and the matter was adjourned to allow time for a pre-sentence report to be prepared and for sentencing.

Adams was given a suspended sentence with 12 months of reporting probation Oct. 22, 2008. He committed the offence in Grafton April 15, 2008.

Over limit, no inspection

The court has fined Devin Matthew Weihers, 22, Morristown, for having care or control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit, and for operating a vehicle without a valid inspection sticker.

Weihers entered guilty pleas to the charges Oct. 20, 2008. He was fined $1,322.50 for having care or control of a motor vehicle with his blood alcohol level was over the legal limit. He has been given until March 30, 2009 to pay or spend 20 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against him.

Weihers was fined $57.50 for operating a vehicle without a valid inspection sticker. He has been given until March 30, 2009 to pay with no default.

Weihers committed the offences in Morristown Aug. 29, 2008 when he operated a motor vehicle without a valid inspection sticker and had the care and control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Weihers gave breathalyzer readings of 120 and 110.

Breathalyzer offences

The court has fined Leigh Fraser Kellock, 20, Melanson, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit.

Kellock entered a guilty plea to the charge Oct. 20, 2008. He was fined $1,552.50 and has been given until April 27, 2009 to pay or spend 23 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against Kellock.

Kellock committed the offence in Wolfville Ridge Aug. 4, 2008 when he operated a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Kellock gave breathalyzer readings of 190 and 190. --

The court has fined Raymond Alexander Kennedy, 43, New Minas, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit.

Kennedy entered a guilty plea to the charge Oct. 20, 2008. He was fined $1,265 and has been given until March 30, 2009 to pay or spend 19 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against him.

Kennedy committed the offence in Somerset Aug. 8, 2008 when he operated a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Kennedy gave breathalyzer readings of 150 and 150. --

The court has fined Michael Steven Mitchell, 18, Kentville, for having care or control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit.

Mitchell entered a guilty plea to the charge Oct. 20, 2008. He was fined $1,100 and has been given until Aug. 24, 2009 to pay or spend 16 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against him.

Mitchell committed the offence in Coldbrook July 19, 2008 when he had care and control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Mitchell gave breathalyzer readings of 110 and 100.

Over legal limit

The court has fined Chad Samuel Newcombe, 18, Aylesford, for having care and control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit.

Newcombe entered a guilty plea to the charge Oct. 20, 2008. He was fined $977.50 and has been given until Feb. 23, 2009 to pay or spend 15 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against him.

Newcombe committed the offence in Lake Paul June 14, 2008 when he had care or control of a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. A blood sample showed a blood/alcohol level of 188.

Failed to provide sample

The court has fined Robert Todd Izzard, 32, Kentville, for failing without reasonable excuse to comply with a demand made to him by a peace officer to provide samples of his breath suitable to enable a proper analysis to be made to determine the concentration, if any, of alcohol in his blood.

Izzard entered a guilty plea to the charge Oct. 20, 2008. He was fined $1,207.50 and has been given until March 30, 2009 to pay or spend 18 days in custody on willful default. The court imposed a one-year, Canada-wide driving prohibition against Izzard.

Izzard committed the offence in Kentville Aug. 22, 2008.

Included offence of possession

The court has fined Sherry Marie Renouf, 32, Aldersville, and sentenced her to a term of probation for the included offence of possession of cannabis marijuana, a substance listed in Schedule II of the Controlled Drugs and Substances Act.

Renouf had been charged with possession for the purpose of trafficking, but entered a guilty plea to the included offence of possession May 26, 2008. However, the court struck the plea and the matter was adjourned to June 2, 2008 for plea. Renouf entered a not guilty plea to the charge of the included offence of possession June 21, 2008. The matter was adjourned to Oct. 21, 2008 for trial.

Renouf changed her plea to guilty prior to the scheduled trial Oct. 21. She was fined $575 and has been given until June 29, 2009 to pay or spend eight days in custody on willful default. The court sentenced Renouf also to a six-month term of probation.

Renouf committed the offence in Kentville April 2, 2008.

Drove while disqualified

The court has fined Charles Douglas Carr, 53, Kentville, for operating a motor vehicle while disqualified from doing so.

Carr entered a guilty plea to the charge on Oct. 20, 2008. He was fined $920 and has been given until Feb. 23, 2009 to pay or spend 14 days in custody on willful default.

Carr committed the offence in Somerset Aug. 8, 2008.

Drove without license

The court has fined Mark David Houghton, 33, Baxter’s Harbour, for unlawfully driving a motor vehicle while his privilege of obtaining a license was revoked.

Houghton entered a not guilty plea to the charge Aug. 7, 2007. After the matter was adjourned on a number of occasions, a trial date was set for Oct. 23, 2008.

Houghton was found guilty following the trial Oct. 23. He was fined $500 and has been given until Jan. 26, 2009 to pay with no default.

Houghton committed the offence in Kentville July 25, 2007.

Possessed prohibited weapon

The court has fined David Lawrence Johnson, 29, Aylesford, for possessing a prohibited weapon without lawful excuse.

Johnson entered a guilty plea to the charge Oct. 20, 2008. He was fined $115 and ordered to pay the fine that day.

Johnson committed the offence in Aylesford Aug. 29, 2008.

Committed mischief

The court has handed George Kelly Meister, 47, Kentville, a suspended sentence with probation for two counts of willfully failing to comply with a probation order by which he was bound and for committing mischief by willfully damaging the property of an individual to a value not exceeding $5,000.

Meister entered guilty pleas to all three charges Oct. 20, 2008. Meister was given a suspended sentence with one-year of reporting probation.

He committed the offence of mischief by willfully damaging property and the first offence of failing to comply with a probation order by which he was bound in Kentville Aug. 15, 2008. The second offence of failing to comply with a probation order occurred in Kentville Sept. 21, 2008.

Probation offence

The court has sentenced Catherine Marie Wade, 44, Grafton, to one day in custody deemed served for failing without reasonable excuse to comply with a probation order by which she was bound.

Wade entered a guilty plea to the charge Oct. 21, 2008. The court sentenced Wade to one day in custody deemed served.

Wade committed the offence in Grafton Oct. 20, 2008.
