Breathalyzer offences

The court has fined Michael Paul Deveau, 47, Kentville, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration thereof in his blood exceeded the legal limit.

Deveau’s defense counsel entered a guilty plea to the charge on his behalf Oct. 17, 2008. The court fined Deveau a total of $1,322.50. He has been given until Feb. 24, 2009 to pay or spend 20 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against him.

Deveau committed the offence in Kentville Sept. 11, 2008 when he operated a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Deveau gave breathalyzer readings of 150 and 160. --

The court has fined Reginald Douglas Bowes, 44, Dartmouth, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration thereof in his blood exceeded the legal limit.

Bowes entered a guilty plea to the charge Oct. 20, 2008 and was fined a total of $1,380. He has been given until Jan. 27, 2009 to pay or spend 21 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against Bowes, with the ignition interlock program after the first three months.

Bowes committed the offence in Welsford Aug. 10, 2008 when he operated a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Bowes gave breathalyzer readings of 150 and 160.

Included offence of theft

The court has handed Luke Arthur Reynolds, 24, Windsor, a suspended sentence with probation for the included offence of attempted theft.

Reynolds entered a guilty plea to the included offence of attempted theft Sept. 5, 2008. The matter was adjourned to Oct. 17 for sentencing. The court gave Reynolds a suspended sentence with 12 months’ probation Oct. 17.

Reynolds committed the offence in Windsor Nov. 26, 2007.
