Probation, restitution for theft, fraud charges
The court has handed Christopher Robert Sherman, 28, Kentville, a suspended sentence with probation and has ordered him to pay restitution after Sherman entered guilty pleas to one count of stealing property of a value not exceeding $5,000 and six counts of defrauding businesses and individuals of merchandise and sums of money valued at less than $5,000.
Sherman entered a not guilty plea April 3, 2008 to the charge of unlawfully stealing property from an individual, but changed his plea to guilty May 20, 2008.
He entered guilty pleas May 20 to three counts of defrauding businesses and one count of defrauding an individual. The matters were adjourned to Aug. 25, 2008 to allow time for a pre-sentence report to be prepared and for sentencing. Sherman entered guilty pleas to two more counts of defrauding individuals Aug. 25.
The court handed Sherman a suspended sentence with two years’ probation on the seven charges Aug. 25. Sherman was ordered to pay restitution through the court to the benefit of each of the seven victims, totaling $5,895.86. Sherman must make restitution in the amount of $250 per month to each of the victims, with the first payments due Sept. 15, 2008 and the following payments being made no later than the 15th of each month thereafter until the restitution orders are paid in full.
Sherman committed the offence of unlawfully stealing property from an individual of a value not exceeding $5,000 in Dartmouth between Nov. 13, 2007 and Jan. 11, 2008. He must pay $899.64 in restitution.
Sherman committed the three offences of defrauding businesses of merchandise by means of worthless cheques in Bridgewater Feb. 18, 2008 when he defrauded Intelligent Choice Computers of a laptop computer (he must pay $932.25 in restitution); in Bridgewater Feb. 22, 2008 when he defrauded KD Micro Computers of a laptop computer and monitor (he must pay $1,147.87 in restitution); and in Windsor Feb. 29, 2008 when he defrauded Avon Micro Systems of a computer (he must pay $1,096.10 in restitution).
Sherman committed the three offences of defrauding individuals of sums of money not exceeding $5,000 in Windsor Sept. 29, 2007 (he must pay $600 in restitution); in Windsor March 17, 2008 (he must pay $360 in restitution); and in Kentville between March 1 and 3, 2008 (he must pay $860 in restitution).
Breached conditional sentence order
The court has sentenced Dana Rodney Atwell, 25, Canning, to a period in custody for the included offence of unlawful possession of cannabis marijuana, a substance listed in Schedule II of the Controlled Drugs and Substances Act, and for breaching a conditional sentence order by which he was bound.
Atwell had been charged with marijuana possession for the purpose of trafficking, but entered a guilty plea to the lesser and included offence of possession Aug. 26, 2008 during an appearance in Windsor Provincial Court.
Atwell admitted he breached a conditional sentence order by which he was bound by failing to keep the peace and be of good behaviour and by failing to refrain from the consumption of alcohol or other intoxicating substances, and by failing to refrain from taking or consuming drugs except in accordance with a medical prescription.
Atwell was ordered by the court to spend 45 days in custody for breaching the conditional sentence order and was sentenced to 15 days in custody, to be served consecutively, for the included offence of marijuana possession. The court ordered Atwell to submit to random urinalysis testing as directed by the conditional sentence supervisor.
Atwell committed the offences in Kentville Aug. 21, 2008.
Breathalyzer offence
The court has fined Jonathon Frederick Blanchard, 20, St. Croix, for operating a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded the legal limit.
Blanchard entered a guilty plea to the charge Aug. 26, 2008. He was fined $1,380 and has been given until Aug. 25, 2009 to pay or spend 21 days in custody on willful default. The court has imposed a one-year, Canada-wide driving prohibition against Blanchard.
Blanchard committed the offence July 13, 2008 in Three Mile Plains when he operated a motor vehicle having consumed alcohol in such a quantity that the concentration in his blood exceeded 80 mg of alcohol in 100 ml of blood, the legal limit. Blanchard gave breathalyzer readings of 180 and 180.
Failed to comply
The court has handed Arthur James John Cordeau, 20, Windsor, a suspended sentence with probation for failing without lawful excuse to comply with a condition of an undertaking by which he was bound.
Cordeau entered a guilty plea to the charge June 20, 2008. The matter was adjourned to Aug. 26 to allow time for a pre-sentence report to be prepared and for sentencing. The court handed Cordeau a suspended sentence with eight months of probation.
Cordeau committed the offence in Bramber May 12, 2008 when he failed without lawful excuse to comply with a condition of an undertaking by which he was bound, to wit, to have no direct contact with an individual.
Fine, probation for offences
The court has fined Franklin Dale McKay, 19, New Minas, and handed him a suspended sentence with probation for failing to drive or operate a motor vehicle in a careful and prudent manner; stealing property from a business of a value not exceeding $5,000; and for failing without reasonable excuse to comply with the conditions of a probation order by which he was bound.
McKay entered guilty pleas to the charges Aug. 26, 2008. He was fined $575 for failing to drive or operate a motor vehicle in a careful and prudent manner. He has been given until Aug. 25, 2009 to pay.
The court handed McKay a suspended sentence with six months’ probation for stealing property from a business, a TV monitor, the property of Hoods Hardware and Automotive Limited, and for failing without reasonable excuse to comply with the conditions of a probation order by which he was bound, to wit, to keep the peace and be of good behaviour.
McKay committed the offences in Windsor June 27, 2008.
